Terms and Conditions of Sale FJELLHEIMEN GALLERI
It is important that you read and understand these terms and conditions before proceeding with this transaction. If there is any term that you do not understand or do not wish to agree to, please discuss it with us. Only proceed with this transaction if you wish to be bound by the terms and conditions set out below.
This agreement applies as between you, the User of this Web Site and Fjellheimen Galleri / Orsolya Haarberg (“Fjellheimen Galleri”, “we”, “us”, our”).
Your order constitutes a contractual offer and our acceptance of that offer is deemed to occur upon our sending a dispatch email to you indicating that your order has been fulfilled. However, a party is not bound by the contract if there are orthographical or typological errors in the offer from Fjellheimen Galleri in the ordering solution of the online shop or in your order, and the other party realised or should have realised that such an error was present.
1. PURPOSE AND EFFECT
These terms and conditions set out all the terms of agreement other than price between you as buyer and us as seller, in relation to the sale and purchase of the item or items identified in the invoice, which we refer to below as “the Work”. We confirm that we either own the Work or are authorised to sell it on behalf of the owner.
If you wish to rely on any variation of, or addition to these terms and conditions, you must ensure that the variation or addition has been agreed by us in writing.
2. PAYMENT OF PURCHASE PRICE
You must pay us the full price for the Work, together with any agreed delivery or framing costs, any VAT and any amounts payable to us by credit card, bank transfer (vipps) or such other methods as we agree. You shall not be charged for any further costs of which we have not informed you before the purchase.
3. EXPORT
If the Work is being ordered from outside Norway, import duties and taxes may be incurred once it reaches their destination. Fjellheimen Galleri is not responsible for these charges and we undertake to make no calculations or estimates in this regard. If you are buying internationally, you are advised to contact your local customs authorities for further details on costs and procedures. Please be aware that your package may be inspected on arrival at port for customs purposes and Fjellheimen Galleri cannot guarantee that the packaging of your goods will be free of signs of tampering.
You will be responsible for paying any taxes that have to be paid in the country of destination whether on shipment or on import or at any other time.
4. DELIVERY
Delivery has occurred once you or your representative has taken possession of the Work.
If the delivery time is not stated in the ordering solution, Fjellheimen Galleri shall deliver the Work to you within a reasonable time frame and no later than 30 days after the order is placed by the customer. The Work shall be delivered to your address unless other, special arrangements are made between the parties.
5. COPYRIGHT
The copyright subsisting in all images and other materials produced for the sale of the Work is owned by us and such images and materials may only be used with our permission. During the period in which the Work is protected by copyright, the copyright remains with its author (or any person to whom that right has been assigned). You are purchasing the Work, but not the right to produce copies of the Work (including photographs thereof) for publication. If such rights are sought, you should contact the copyright owner.
6. REFUNDS
If you have concluded a transaction exclusively at a distance you have the right to cancel the contract for the purchase of the Work in question within 14 days (including all calendar days), beginning with the day after the day the Work is collected/delivered.
This right extends only to Works returned in the same condition in which they were sold. You will be responsible for the costs of returning the Work to us.
When the right to cancel is exercised, the good must be returned to Fjellheimen Galleri within a reasonable amount of time and no later than 14 days after notice has been given on the intention to exercise the right.
Fjellheimen Galleri has the right to retain the reimbursement until it has received the Work from you.
7. TERMINATION
If Fjellheimen Galleri does not deliver the Work at the time set for delivery, you shall call on us to deliver within a reasonable additional time frame for performance. If we do not deliver the Work within the additional time frame, you may cancel the purchase.
8. CONFLICT RESOLUTION
Claims must be directed to the us. The parties shall attempt to resolve any disputes out of court. If this is not successful, you may contact the Consumer Council of Norway for mediation. The Consumer Council may be reached on (+47) 23 400 500 or at www.forbrukerradet.no
